Terms of Sale

1. Purpose and Scope
These Terms of Sale (hereinafter "ToS") govern transactions for the purchase and sale of Trading Card Game (TCG) collectible cards between Users of the Atticard platform (hereinafter "the Platform").
The Platform is operated by Atticard, a micro-enterprise registered in France, accessible at https://atticard.com.
These ToS apply to all transactions made via the Platform and supplement the Terms of Service.
Any transaction made via the Platform implies full acceptance of these ToS by the Buyer and Seller.
2. Platform Role
Atticard is a platform connecting Sellers and Buyers. The Platform is not a party to sales contracts concluded between Users.
Atticard acts as a host within the meaning of Law No. 2004-575 of June 21, 2004 for confidence in the digital economy. As such, Atticard only has an obligation of means regarding monitoring published content.
Atticard nevertheless provides services facilitating Transactions:
3. Seller Obligations
Sellers commit to:
Listing Publications
Sellers freely publish their Listings on the Platform. Each Listing must include a detailed description of the Card (name, edition, language, condition, variant) and at least one photograph.
The sale price is freely set by the Seller. However, Atticard reserves the right to remove any Listing whose price is manifestly disproportionate or contrary to good business practices.
The Seller guarantees the Card's availability as long as the Listing is online.

5.1. Sale price
The sale price is freely set by the Seller and displayed in euros (€).
The displayed sale price corresponds to the amount the Seller will receive in their Stripe Wallet after Transaction validation.
5.2. Buyer protection fees
For each Transaction made via the Platform, Buyer protection fees of 5% of the sale price, plus €0.70, are applied.
These fees are charged to the Buyer and constitute a security guarantee for the transaction (secure payment system, dispute management, automatic validation, shipment tracking).
The Seller receives the full sale price (100%) in their Stripe Wallet after Transaction validation.

- Sale price: €100.00
- Buyer protection fees: €5.70 (5% + €0.70)
- Total price paid by Buyer: €105.70 (excluding shipping fees)
- Amount received by Seller: €100.00
5.3. Shipping fees
Shipping fees are charged to the Buyer, unless otherwise stated in the Listing.
Shipping fees are automatically calculated based on the carrier (Mondial Relay) and package weight.
6. Payment Terms
6.1. Payment and security
Payments are managed via Stripe, an approved payment service provider.
The Buyer pays the total Transaction price (sale price + Buyer protection fees + shipping fees) when validating their order.
Payment is immediately captured and held by the Platform until Transaction validation.
Payment data (credit card numbers, bank details) are collected and stored exclusively by Stripe. Atticard does not have access to Users' complete payment data.
6.2. Seller Wallet (Stripe Connected Account)
Any Seller wishing to receive proceeds from their sales must create a Wallet by providing information required by Stripe (identity, date of birth, address, identity documents).
The Seller receives the full sale price in their Stripe Wallet only after Transaction validation by the Buyer or automatic validation.
The Seller can use their Wallet balance to make purchases on the Platform or request a transfer to their bank account (IBAN).
Adding a bank account (IBAN) is only necessary if the Seller wishes to withdraw funds to their bank account. They can accumulate a balance in their Wallet and use it for purchases without ever making a withdrawal.
7. Delivery
7.1. Carrier
Deliveries are provided by Mondial Relay.
The Seller generates a shipping label directly from the Platform and must hand over the package to a Mondial Relay point within 7 days following label creation.
7.2. Packaging
The Seller commits to carefully packaging Cards to avoid any damage during transport.

7.3. Automated shipment tracking
Atticard performs automatic package tracking via the Mondial Relay API.
An automated system ("cron job") checks shipment status every 30 minutes (from 8am to 7pm, Paris time).
Automatic notifications and emails are sent to Users at each status change (shipment, delivery, pickup).
7.4. Package pickup
The Buyer must collect their package from the designated Mondial Relay pickup point within specified timeframes (generally 14 days).
In case of non-pickup within timeframes, the package will be returned to the Seller and the Transaction may be cancelled.
8. Transaction Process
8.1. Transaction lifecycle
Each Transaction follows an automated process comprising several steps:
- 1.Purchase validated: Buyer pays, payment is captured;
- 2.Label created: Seller generates shipping label (deadline: 5 days);
- 3.Shipment: Seller hands over package to carrier (deadline: 7 days after label creation);
- 4.Delivery: package arrives at pickup point;
- 5.Pickup: Buyer collects package;
- 6.Validation: Buyer validates receipt or Transaction is automatically validated (deadline: 5 days after pickup);
- 7.Payment to Seller: funds are transferred to Seller's Wallet.
9. Automatic Cancellation
9.1. Cancellation for non-creation of label
Deadline: 5 days from Transaction creation.
If the Seller does not create a shipping label within 5 days following purchase, the Transaction is automatically cancelled.

9.2. Cancellation for non-shipment
Deadline: 7 days from shipping label creation.
If the Seller does not hand over the package to the carrier within 7 days following label generation, the Transaction is automatically cancelled.

10. Automatic Validation
Deadline: 5 days after package pickup by Buyer.
If the Buyer does not validate receipt nor open a Dispute within 5 days following package pickup, the Transaction is automatically validated.

ℹ️ Important
Automatic validation means that Buyer silence equals Transaction acceptance.
The Buyer is invited to check the Card condition upon receipt and report any problem before the 5-day deadline expires.
11. Disputes
11.1. Opening a Dispute
In case of Transaction problem (non-conformity, damaged Card, Card not received, counterfeit), the Buyer can open a Dispute via their Account within 5 days following package pickup.
Opening a Dispute suspends fund transfer to the Seller.
11.2. Dispute procedure
Each party can provide evidence (photos, descriptions, messages).
Atticard intervenes as mediator and examines elements provided by both parties.
11.3. Dispute decision
Atticard renders a final decision which may be:
Atticard's decision is final and binding on both parties.
However, in case of persistent disagreement, parties may resort to consumer mediation (see article 15).
12. Reviews and Reputation
After Transaction validation, Buyer and Seller can leave a review (rating from 1 to 5 stars and optional comment).
Reviews are public and visible on User profiles. They contribute to each User's reputation.
Reviews must be factual, courteous, and related to the Transaction.
Atticard reserves the right to moderate or delete any abusive, defamatory, or manifestly inappropriate review.
Automatic reviews
In case of automatic cancellation for Seller non-response or non-shipment, an automatic 1-star review is created by the system.
This review is identified as "automatically generated" and cannot be modified or deleted.
13. Legal Warranties
Since Transactions are concluded between individuals (consumers), no legal warranty of conformity (articles L217-4 et seq. of the Consumer Code) nor warranty against hidden defects (articles 1641 et seq. of the Civil Code) applies for the Buyer's benefit.
However, in case of Dispute, Atticard may intervene to facilitate an amicable settlement.
The Platform is not responsible for the quality, conformity, authenticity, or legality of Cards sold. This responsibility lies exclusively with the Seller.
14. Limitation of Liability
Atticard acts as host and transaction facilitator. Responsibility for Cards sold (quality, conformity, authenticity, legality) lies exclusively with the Seller.
Atticard cannot be held responsible for:
Atticard nevertheless commits to implementing all necessary means to facilitate smooth Transaction progress and resolve disputes fairly.
15. General Provisions
15.1. Consumer mediation
In accordance with articles L611-1 et seq. of the Consumer Code, any consumer has the right to resort free of charge to a consumer mediator in case of unresolved dispute with Atticard.
Atticard is in the process of appointing a consumer mediator. Pending this official appointment, you may resort to the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr
Important: resorting to consumer mediation is optional and free. It can only be initiated after attempting to resolve the dispute directly with Atticard.
15.2. Applicable law
These ToS are subject to French law.
15.3. Competent jurisdiction
Any dispute relating to the interpretation, execution, or validity of these ToS falls under the exclusive jurisdiction of French courts, except for mandatory legal provisions to the contrary.
In accordance with competence rules applicable in consumer matters, the consumer User may choose to bring action before the court of the place where they resided at the time of contract conclusion or harmful event occurrence.
15.4. ToS modification
Atticard reserves the right to modify these ToS at any time to adapt them to Platform, legislation, or regulation changes.
Users will be informed of any substantial modification by email or Platform notification at least 15 days before new ToS take effect.
